Why sex with women captured in war is halal in Islam

Brother Zakir Naik explains why Allah(SWT) in his wisdown has made halal for muslims, sex with slaves and women captured in war. Brother says that this seemingly "outdated" practise is still far superiour to the way inmates are treated at the Guantanamo Bay. Note that sex with women distributed from the spoils of war did NOT count as one of the four wives permissible under Islamic shariah law.

Of course, brother doesnt realise that the Quran is immutable word of Allah and his messenger whereas UN charter is man made and can be modified. In fact the provision for repealing obsolete laws, modifying existing laws and legislating news ones is the beauty of secular law. Our society is constantly evolving as is our sense of morality. Today, we live in a world that is far more morally advanced than the world of 2,000, 1000 or even 500 years ago. We consider witch burning, cruel punishments like limb amputation and beheading, etc to be morally reprehensible. Racist, sexist behaviour etc is no longer socially acceptable today although they were perfectly fine not too long ago. Our hang up with child genital mutilation, animal sacrifice etc which is a product of religion will no longer be accepted in future.

Brother also compares the banning of consumption of alcohol in stages to legalising sex with "right hand possessions" or women captured in war. I fail to understand how such a comparison can be made. The argument is that alcohol was banned in stages so that it was easier on people who had already made it a habit to give it up, because alcohol is an addictive drug. What has that got to do with taking right hand possessions for our sexual pleasure. Why didnt Allah and his messenger ban this practise, even if it was a carry over from pre Islamic times.

Qur'an (33:50) - "O Prophet! We have made lawful to thee thy wives to whom thou hast paid their dowers; and those (slaves) whom thy right hand possesses out of the prisoners of war whom Allah has assigned to thee"

Qur'an (23:5-6) - "..who abstain from sex, except with those joined to them in the marriage bond, or (the captives) whom their right hands possess..."

Qur'an (4:24) - "And all married women (are forbidden unto you) save those (captives) whom your right hands possess."

It is clear from these verses in the Quran that neither slavery nor sex with slaves was prohibited by Allah or his messneger Muhammad(pbuh). It is the secuakar law that is preventing the muslims from keeping slaves and having sex with women captured in war.
