B’Tselem and the Israel ‘Apartheid’ Myth

OPINION

News organizations have given prominent coverage to a report published by the organization B’Tselem, which claims that Israel is no longer a democracy but an “apartheid regime” devoted to cementing the supremacy of Jews over Palestinians.

By uncritically portraying this group as a leading proponent of human rights, the media has effectively facilitated the hijacking of the word apartheid by anti-Israel activists, whose goal is to foster doubt about the legitimacy of the Jewish state.

Besides the emotional response that apartheid evokes, it is also a clearly defined crime against humanity under international law. Not a single country other than South Africa has ever been charged by the international community with imposing apartheid on its people.

None of the world’s worst human rights violators have been placed in this docket:

Afbeelding

By subjecting Israel to a double standard, B’Tselem and, in turn, the media have blurred the fine line between legitimate criticism of Israeli policies and antisemitism.

B’Tselem’s troubling history of blatant anti-Israel activities has been glossed over. Indeed, the organization was instrumental in pressuring the United Nations to investigate Israel’s conduct following the 2009 Gaza War (Operation Cast Lead) that was initiated by the Hamas terrorist group.

The result was the one-sided, and subsequently debunked, so-called Goldstone Report. B’Tselem is mentioned 56 times in the document, which was widely used to legitimize extreme biases and mainstream libels against Israel.

Later, expressing regrets over the report he helped compile, Richard Goldstone, who is of South African heritage and has an extensive legal background, said, “In Israel, there is no apartheid. Nothing there comes close to the definition of apartheid.”

Seemingly, B’Tselem’s past efforts to single out Israel for condemnation would be crucial for news outlets to note. Instead, the Associated Press had this to say (opine?):
  • That a respected Israeli organization is adopting a term long seen as taboo even by many critics of Israel points to a broader shift in the debate as its half-century occupation of war-won lands drags on and hopes for a two-state solution fade.
And while B’Tselem is described merely as a left-wing organization, it is actually a member of the Fédération Internationale des Droits de l’Homme (FIDH), a Paris-based association of global NGOs that is active in worldwide Boycott, Divestment, and Sanctions (BDS) campaigns.

The FIDH has pushed for the European Union to adopt guidelines preventing the labeling of West Bank products as “Made in Israel,” and lobbied for the UN Human Rights Council to establish a commission of inquiry into Israel’s actions during the 2014 Gaza War, which was also started by Hamas.

Previously, B’Tselem for the most part limited its criticism to Israeli policies that apply to Palestinians living beyond the pre-1967 borders (i.e. the West Bank, Gaza Strip, and the eastern part of Jerusalem). Now, the organization appears to have ventured into new territory: claiming that Zionism — namely, the right of Jewish people to self-determination — has produced an apartheid regime, even within what is regarded as Israel proper:
  • Israel is not a democracy that has a temporary occupation attached to it; it is one regime from the Jordan River to the Mediterranean Sea, and we must look at the full picture and see it for what it is: apartheid.
Yet, facts are stubborn things, and in Israel, unlike the past situation in South Africa, national law guarantees equal rights for all.

And while the situation in the West Bank is more complex, Israel has on multiple occasions offered the Palestinians generous peace deals to end the prevailing status quo. Indeed, every Israeli prime minister since Yitzhak Rabin over a quarter century ago has publicly accepted in principle the eventual creation of a Palestinian state, only to be rebuffed by Ramallah.

Whereas the ultimate fate of the West Bank is a matter of robust debate even amongst Israelis, what is certain is that the media has spread an outright falsehood by suggesting that Israel is an apartheid state. Arab-Israeli citizens have the same freedom of movement and speech as their Jewish counterparts; receive an education and health care; are able to vote; and can work in whatever professions they choose. They also serve throughout the government, in the Knesset, and on the Supreme Court.

But the news coverage of B’Tselem and its latest report paints a distorted picture. As a result, opponents of the Jewish state can more readily discharge a loaded word that is not only totally inaccurate, but also used as ammunition by those who want to see Israel eradicated.

And the media is seemingly all-too-eager to jump on the bandwagon.

Spoiler! :
Made in Israel

‘Israëlische medjoel (dadel) is foute boel.

Opinie: ‘Tendentieuze apartheidskritiek brengt Palestijnen nergens’

Hoezo apartheid?

Anti-Israel ice cream? Ben & Jerry’s boycotts Israeli settlements, blasted as ‘moral mistake’

“We believe it is inconsistent with our values for Ben & Jerry’s ice cream to be sold in the Occupied Palestinian Territory,” read a statement. Israeli PM Bennett called it a “moral” and “business mistake.”

In a victory for the BDS (Boycott, Divestment, and Sanctions) movement, popular ice cream brand Ben & Jerry’s announced that it will no longer sell its products in Judea and Samaria.
“We believe it is inconsistent with our values for Ben & Jerry’s ice cream to be sold in the Occupied Palestinian Territory,” read a statement from the company.
“We have a longstanding partnership with our licensee, who manufactures Ben & Jerry’s ice cream in Israel and distributes it in the region. We have been working to change this, and so we have informed our licensee that we will not renew the license agreement when it expires at the end of next year.
“Although Ben & Jerry’s will no longer be sold in the OPT, we will stay in Israel through a different arrangement. We will share an update on this as soon as we’re ready.”

The statement came two months after social media users blasted the brand for not supporting the Palestinians during the May 2021 Gaza – Israel clash.
After carefully cultivating a social media presence focused on left-wing activism, many people lobbied criticism of the brand for suddenly ceasing to post in the aftermath of Operation of Operation Guardian of the Walls.
Earlier in 2021, the brand’s Twitter account called for the police to be defunded, the end of protections from prosecutions for police officers, which it deemed a “racist” policy, and for the “dismantling of the prison industrial complex.”
The ice cream brand even slammed UK Home Secretary Priti Patel for her statements about enforcing UK border law, accusing her of showing a “lack of humanity for people fleeing war, climate change and torture.”

The brand was founded in the 1970s by Jewish-American friends Ben Cohen and Jerry Greenfield. It was purchased by the multinational company Unilever in 2000 for some $326 million.

Prime Minister Naftali Bennett responded to the announcement on Twitter, writing “Ben & Jerry’s decided to brand itself as anti-Israel ice cream. This is a moral mistake and I believe it will turn out to be a business mistake as well.
“Boycotting Israel — a democracy surrounded by islands of terrorism — reflects how they have completely lost their way. The boycott does not work and never will; we will fight it with all our might.”

While some Twitter users praised Ben & Jerry’s decision, many said the decision didn’t go far enough.
The statement implied that while Israel would no longer sell its products in Judea and Samaria, it will still be available in the rest of Israel.
“The right thing is to boycott Israel as Israel is an apartheid state. Hopefully Israel will have gotten rid of its apartheid system in 100 years,” wrote one user.
“Total pr stunt! So, you’ll not sell your product in ‘OPT’ but you will sell it in Israel, who are actual occupiers of the ‘OPT’?? Add to that, that israel is itself occupied Palestinian Territory, like wtf?? Why not simply revise to sell your product in Israel full stop!” wrote another user.

One bemused pro-Israel user responded, “I think my favorite part of this is that Ben and Jerry’s virtue signaling still wasn’t enough for people. An ice cream maker boycotts one place on a planet full of far worse human rights abuses, and people are mad that they don’t boycott all of Israel.
“Good job guys. Thumbs up,” he wrote sarcastically.

Ben & Jerry's board wanted to boycott all of Israel

A board member stated that Unilever had overstepped its authority by pledging to remain in Israel.

Ben & Jerry's Independent Board of Directors wanted to boycott Israel in its entirety, but was stopped from doing so by the ice-cream maker's CEO and the British-based parent company Unilever.

"The statement released by Ben & Jerry's regarding its operation in Israel and the Occupied Palestine Territory does not reflect the position of the Independent Board nor was it approved by the Independent Board," read a statement by Ben & Jerry's Independent Board of Directors.

It was posted on social media, including on the Twitter page of board chairwoman Anuradha Mittal.

New York supermarket chains pull Ben & Jerry’s over Israel boycott

“Seasons has removed all Ben and Jerry’s products from all its stores as a result of the ice cream maker’s decision to cease sales in parts of Israel. We stand with Israel. Always.”

Several supermarket chains in the New York area announced Monday that they are pulling Ben and Jerry’s ice-cream from their shelves in immediate response to the company’s decision to stop selling their products in the “occupied Palestinian territories”’ as soon as their local franchise’s license runs out in December 2022.

Seasons, a kosher, upscale chain with stores in New York and New Jersey, sent out a message to its customers Monday evening, saying, “Seasons has removed all Ben and Jerry’s products from all its stores as a result of the ice cream maker’s decision to cease sales in parts of Israel. We stand with Israel. Always.”

The board of directors of Morton Williams Supermarkets quickly met and decided that their 15 stores in the city that never sleeps (and one in New Jersey) would cut 70% of its B&J products, the New York Post reported Tuesday. Co-owner Avi Kaner told the daily that his shops would also stop promoting the brand in its circulars and put what was left in “the least desirable locations” of the freezer section.
While unwilling to alienate certain customers by a complete ban, Kaner said he would work to create a domino effect to send a “strong message” to B&J.
“Of all the places in the world to boycott, Ben & Jerry’s has chosen to target the one Jewish nation in the world,” he said. The company, he added, is “reaching out to other major retailers and distributors in the hope that they will follow suit.”
Meanwhile, taking to his personal online account, he tweeted out, “Please try Haagen-Dazs ice cream – you’ll love it!”

Others outraged at the anti-Israel message are also thinking in broader terms. In a move that would automatically remove B&J from the shelves of all stores that serve a high percentage of Orthodox clientele, social activists have begun calling KOF-K Kosher to ask that the organization pull its kashruth certification from the ice cream. They are also requesting that other certifications refuse to service Ben and Jerry’s as substitutes.

Two popular big groceries, Aron’s Kissena Farms in Queens, and Glatt Express Supermarket in Teaneck, N.J., aren’t waiting and announced that they have already removed the ice cream from their shelves in support of the Jewish state.

A number of other stores in the New York region that carry Ben & Jerry’s have followed suit as well as Kosher Kingdom in Melbourne, Australia.

The heaviest guns may be laws that are already on the books in many American states, as noted by Israeli Foreign Minister Yair Lapid.
“Ben and Jerry’s decision is a shameful surrender to anti-Semitism, to BDS, to all the evil in the anti-Israel and anti-Jewish discourse,” he said.
“We will not keep quiet. More than 30 states in the United States have laws against surrendering to BDS that have passed in recent years. I plan to go one by one and demand that they enforce these laws against Ben & Jerry’s because they will not treat us in this way without encountering a response.”

The decisions made by the Executive Board of Norges Bank, announced last week, were made based on recommendations from the Council on Ethics,” said Line Aaltvedt, a spokesman for Norges Bank. “The Ministry of Finance has established the independent Council on Ethics to evaluate whether or not the fund’s investments in specified companies is consistent with its Ethical Guidelines.
This pension fund boycotts Israel, but invests in Chinese slave labor

A Norwegian pension fund that recently announced it planned to blacklist Israeli companies in the West Bank has poured hundreds of millions into Chinese companies linked to slave labor and Russian entities on the U.S. sanctions list.

Norges Bank’s Government Pension Fund Global, Norway’s largest pension fund, placed several Israeli companies in the West Bank on its “excluded companies” list earlier this month, citing “serious infringements of the rights of the individual in situations of war or conflict in connection with the construction of roads linked to Israeli settlements in the West Bank.”

At the same time, Norges held over $150 million in investments in at least seven companies that operated in or are suspected of using forced labor from the Xinjiang province of China, where Uyghur Muslims face human rights abuses, according to the fund’s most recent financial disclosures from last December.
The fund also held $1.8 billion in shares in at least six Russian energy companies and banks that are under U.S. financial restrictions or sanctions.
The fund’s investments raise questions about its decision-making process for divestments. While Norges Bank cut ties with Israeli companies, it has yet to bar controversial Russian and Chinese companies from future investments. Anti-Israel boycotts are growing more common in progressive circles. Earlier this year, Ben & Jerry’s announced it was ending its operations in the West Bank, prompting a wave of public backlash and the threat of financial penalties against the ice cream company from several U.S. states.

Ben & Jerry’s may lose kosher certification due to boycott

“We are hopeful that Ben & Jerry’s will reverse their decision and that there will be some sort of resolution,” said Kof-K’s chief operation officer.

Ben & Jerry’s could lose its kosher certification from the Kof-K kosher agency if it carries out its plan to boycott Jewish communities in Judea and Samaria, The Jerusalem Post reported Friday.

“We have told Ben & Jerry’s that we do not know if we will be able to renew our contract,” Rabbi Daniel Senter, chief operating officer of the American-based Kof-K that provides kosher international certification, told the Post.
Senter told the Post that Kof-K can break the contract only if the company is found to have violated the laws of kashrut.
“Our concern is Ben & Jerry’s [pending] action of withdrawing distribution of products in Judea and Samaria,” Senter told the Post. “We are hopeful that Ben & Jerry’s will reverse their decision and that there will be some sort of resolution.”
The current certification expires in 2022.
Meanwhile, Kof-K “is living up to its side of the contract,” Senter said.
Removing the certification is a process, he explained, and would require a decision by its rabbinic board.

Regarding the decision, the Post added, Senter and his brother Ari, the agency’s senior rabbinic coordinator, visited Israel last week on a trip organized by Yigal Dilmoni, CEO of the Yesha Council, the umbrella organization of the Jewish communities of Judea, Samaria and the Jordan Valley.

They met with Religious Affairs Minister Matan Kahana as well as with Dilmoni and Avi Zimmerman, president of the Judea and Samaria Chamber of Commerce, according to the Post.

Palestinian sues Ben and Jerry’s for discriminating against Palestinians

A Palestinian human rights advocate is suing the owner of Ben and Jerry’s ice cream over its plans to withdraw sales of its product from Jewish settlements in Judea and Samaria.

Claiming the move discriminates against Palestinians such as himself, the suit also alleges that the withdrawal amounts to a de facto boycott of the whole of Israel.

The suit is being brought by Bassam Eid, a former researcher for B’Tselem who now advocates for Palestinian human rights without antisemitism. According to a copy of the suit seen by pro-Israel Blogger Elder of Ziyon, the case has been filed with the New York State Division of Human Rights against Conopco Inc, charging the company with aiding and abetting “an unlawful discriminatory boycott.”
Spoiler! :
The ice cream company announced in July that it would cease selling its products in Judea and Samaria.
We have been working to change this, and so we have informed our licensee that we will not renew the license agreement when it expires at the end of next year.”

On the same day as the announcement was made, Conopco Inc announced its support of the decision, “effectively endorsing the company’s boycott,” the suit details.
In the text of the suit, Eid explains that he believes the move will only serve to raise tensions between Jews and Palestinians, not heal the rift.
“I am a Palestinian Arab human rights activist. I was born in Jerusalem and reside in Jericho,” he wrote. “I have dedicated my life advocating for peace and reconciliation between Israelis and Palestinians. In doing so, I firmly reject the Boycott, Divestment and Sanctions movement, otherwise known as ‘BDS’.

“I believe BDS is counterproductive to peace and creates only more hatred, enmity and polarization, as evidenced by the Respondent’s actions in this matter. Moreover, whereas the BDS movement’s spokespeople and supporters live in comfortable circumstances abroad, such boycotts as this will only result in increased economic hardships for actual Palestinians, such as myself.”

He added: “If so-called pro-Palestinian activists truly want to help the Palestinians’ cause, then they should demand Palestinian leadership respect basic freedom, human rights and democracy for the Palestinian people, while assisting Israel in creating more jobs employing Palestinian people and initiating programs that bring the sides together, not create barriers, walls and only more hate.”

Ben and Jerry’s have said that they intend to keep selling ice cream in the rest of Israel “through a different arrangement,” but Eid believes this will not be possible in practice as it will be illegal for any Israeli distributer to exempt Judea and Samaria. Consequently, Ben and Jerry’s will, in effect, be boycotting the whole of Israel.

“As it is highly unlikely that the Respondent will find an Israeli distributor to be a willing accomplice to such illegal and discriminatory BDS activity, the practical effect of the announcement is a decision to boycott the entire State of Israel,” Eid argued. “Therefore, regardless of where one draws the lines of Israel’s borders, the boycott will also to apply to me, as a resident of Jericho, in the purported ‘OPT’.”

Pointing to statements by Anuradha Mittal, Chairperson of the Ben & Jerry’s Board of Directors, in support of a boycott of Israel, Eid concludes: “In other words, the circumstances of the Ben & Jerry’s announcement indicate that the company’s boycott is intended to engage in an unlawful discriminatory boycott, and the rhetoric about “illegal occupation” is simply a fig leaf for the discriminatory activity.

“The BDS’s movement has had tremendous negative affect on me and other Palestinians, some of whom have lost their place of employment and access to goods and services,” Eid added.

A Palestinian human rights advocate is suing the owner of Ben and Jerry’s ice cream over its plans to withdraw sales of its product from Jewish settlements in Judea and Samaria.

Abusive internet trolls call Dame Helen Mirren 'racist' and an 'Israel-worshipper' for playing Jewish state's only female leader Golda Meir in new biopic

* 'Golda' is set during the Yom Kippur War in 1973 when Arab states attacked Israel
* Internet trolls branded Oscar-winning actress ‘racist’ for depicting Golda Meir
* Dame Helen described Meir as ‘a formidable, intransigent and powerful leader’ and said it was ‘a great challenge to portray' Israel's first female Prime Minister
* But critics on social media called the production ‘fascism’, ‘sick’ and ‘tasteless’

Dame Helen Mirren has been subjected to a torrent of abuse for appearing as Israel’s only female leader in a forthcoming biopic.

Internet trolls branded the Oscar-winning actress ‘racist’ and described her as a ‘well known Zionist and Israel-worshipper’ after taking on the role of wartime prime minister Golda Meir.

The film, Golda, is set during the Yom Kippur War in 1973 when Arab states attacked Israel.

Dame Helen described Meir as ‘a formidable, intransigent and powerful leader’ and said it was ‘a great challenge to portray her at the most difficult moment of her extraordinary life’.

But critics on social media described the production as ‘fascism’, ‘sick’ and ‘tasteless’.

The European Union (EU) announced in November 2015 it will begin to label Israeli products originating from Judea, Samaria and the Golan Heights in an attempt to generate financial pressure on Israel and to protest Israel’s policies in these regions.

The European Court of Justice (ECJ) in November 2019 upheld this decision.
Belgium announces labeling of Israeli products from Judea and Samaria

Belgium has decided to start labeling Israeli products coming from Judea, Samaria, Jerusalem, and the Golan Heights, marking them for boycotts, and Israel’s Deputy Foreign Minister Idan Roll has canceled his meetings in Brussels in protest.

Israel’s Foreign Ministry issued a statement on Wednesday condemning “the Belgian government’s anti-Israel decision.”
[...]
Roll, who took off for a diplomatic visit to Belgium and Luxembourg, canceled his planned meetings with the Belgian Foreign Ministry and Parliament following the decision.

“The Belgian government’s decision strengthens the extremists, does not help promote peace in the region, and makes Belgium a factor that does not contribute to stability in the Middle East,” stated Roll.
Belgium’s move could expose it to US anti-boycotts law as well as state-level sanctions and potentially disrupt US-EU trade relations. Boycotts of Israel are illegal in the US and about half of the states have passed similar laws.

US law professor Eugene Kontorovich has stated that the ECJ’s ruling “is putting a new ‘Yellow Star’ on Jewish-made products,” calling the decision “inconsistent” with the treatment of other disputed areas. Kontorovich pointed out that the ruling set a precedent in product labeling addressing “who” it was produced by, rather than the standard practice of labeling products according to geographic standards.

UK Parliament strikes legal blow against BDS campaign targeting Israel

The British parliament struck a blow against the anti-Zionist campaign to subject the State of Israel to a comprehensive boycott on Tuesday night, when it passed a measure outlawing local authorities in the UK from divesting from pension funds with Israel ties.

An amendment to the Public Service Pensions Bill submitted by Robert Jenrick, a Conservative Party MP who represents the Newark constituency in England, would prevent local authorities from making decisions that conflict with UK foreign policy.

“For too long, we’ve seen public pension schemes pursue pseudo-foreign policies,” Jenrick told the House of Commons during Tuesday night’s debate. “All too often, the foreign policy of these public pension schemes is, I’m afraid, exclusively focused on rewriting the UK’s relationship with the world’s only Jewish state.”

Jenrick added that he intended to deliver on his pledge to “outlaw” the self-styled “boycott, divestment and sanctions” (BDS) campaign. The main goal of the campaign is to isolate Israel economically, politically and culturally and to replace the Jewish state with a Palestinian state extending from the Mediterranean coast to the River Jordan.

Jenrick said his amendment would “merely be the beginning of a wider effort to tackle BDS within the private sector, and that we as a government make good on our manifesto commitment to a full BDS bill.”

Several opposition Labour MPs strongly criticized the amendment. Zarah Sultana, the MP for Coventry South in England, accused the government of “weaponizing” pension funds against “human rights campaigns,” while her colleague John McDonnell, the former deputy leader of the Labor Party, declared: “I don’t believe it is the role of the state to ride roughshod over my moral choices.”

A separate statement from the Labour Muslim Network described the BDS campaign as “a long-standing call from Palestinian civil society to resist illegal occupation, apartheid and human rights abuses.” The group warned that the amendment would negatively impact international advocacy beyond the Palestinians, and would affect “boycott campaigns against China as they continue with their genocide against the Uyghur Muslims.”

Jewish leaders welcomed the parliamentary vote in favor of Jenrick’s amendment. “We thank Robert Jenrick for bringing forward the amendment and the government for supporting it. Councils should be focusing on community cohesion and not stoking division by importing of a foreign conflict through BDS,” said Claudia Mendoza, Co-CEO of the Jewish Leadership Council, in a statement.
